MyRacingPath is in private beta and not open to the public. These policies apply to you now: they are not drafts. We update them as the product changes, and we will tell you before any material change takes effect.

TERMS OF SERVICE

1. About these Terms

  • These Terms of Service form the contract between MY RACING PATH LTD, a company registered in England and Wales (company number 17355031), whose registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, and you, the person using our services.
  • A correspondence address is available on request via support@myracingpath.com.
  • We are registered with the UK Information Commissioner's Office under the Data Protection (Charges and Information) Regulations 2018, registration number ZC223123.
  • By creating an account or using MyRacingPath, you agree to these Terms. If you do not agree, do not use the service.

2. The private beta

MyRacingPath is running as a private beta. That changes some things while the beta lasts, and this section says which. Everything else in these Terms still applies to you.

  • You are here by invitation, using an access code we gave you. Please do not share your code, and please do not invite anyone else. Each code belongs to one tester.
  • Beta means things break. Features can change, move, or disappear. Data you enter can be reset. The service can be unavailable without notice. Please do not treat MyRacingPath as your only record of anything that matters to you, and keep your own copy of anything important.
  • Nobody is charged during the beta. Subscriptions are closed, we take no payment, and any paid features on your account were switched on by us at no cost. If that ever changes, we will tell you before anyone is asked to pay for anything.
  • We will ask you for feedback. Sending it is optional, and nothing happens to your account if you would rather not. If you do send us an idea, a bug report, or a suggestion, we can use it in the product without owing you anything for it. Anything you upload stays yours, exactly as the User content and licence section below says.
  • Every other part of these Terms applies during the beta, and so do our Privacy Policy, Safeguarding Policy and Community Guidelines. Those are not drafts. They apply to you now.
  • We can end the beta, or end your access to it, at any time. If we do, you can export your data first from your account settings, or ask us for it at support@myracingpath.com.

3. Eligibility and account creation

  • MyRacingPath is offered to residents of the United Kingdom only. United Kingdom is the only country of residence our sign-up form offers, and our servers reject any other. Nothing here is an offer to anyone outside the UK.
  • You must be at least 13 to open an account for yourself. In the UK, 13 is the age at which you can agree on your own to an online service handling your data, and we treat consent you give at 13 or over as your own valid consent under Article 8 UK GDPR.
  • If you are 13 to 17 you can use MyRacingPath in your own right, and you do not need a parent's permission for what we do with your data. A contract is a different question: under English law a contract with someone under 18 is not fully binding on them, which is one reason nobody under 18 can buy anything here. Any paid subscription covering an under-18 driver must be held by a parent or guardian, and there are two ways to hold one: an individual plan in the parent or guardian's name, or a Team, with the parent or guardian as the team manager and the driver on a driver seat. Checkout is closed to everyone for the whole beta.
  • If you are under 18 and join a Team, the join needs approval from your parent or guardian first. We email them a link, they see what the team manager would be able to view, and nothing is shared until they approve.
  • If you are under 13, you cannot have an account. Sign-up asks for your date of birth and refuses anyone under 13, and there is no parental consent route around that minimum age. Our Parental Consent Policy sets this out in full.
  • You are responsible for keeping your account credentials secure and for all activity on your account. Notify us immediately of any unauthorised access.
  • We may suspend or terminate accounts where users have provided false information, including misrepresenting their age.

4. Our service

MyRacingPath is a digital platform that helps drivers plan and develop their motorsport careers. Features include:

  • Driver profiles and Skill Score assessments.
  • The Racing Path career planner (the “Racing Path”): you build your own multi-year path in the path editor from our championship catalogue. On the Max plan the Path Agent can work on a draft copy with you, and nothing changes your saved path until you press Save. You can ask the AI to review a saved path at any time.
  • Championship database and browsing.
  • AI-powered coaching via our “Race Engineer” feature.
  • Season planning tools.
  • Session analysis and lap time data tools (Pro tier and above).
  • Timing results import from supported third-party timing providers (Pro tier and above).
  • Sponsorship outreach tools (Max tier; see the Sponsorship agent section below).
  • Academy learning content.
  • Team accounts (a manager seat plus driver seats, for a coach, academy, or a parent or guardian running one or more drivers). A team manager can see a driver's racing record. What that covers is disclosed in the app before anyone joins, and it never includes the driver's AI chat conversations.

Features available to you depend on your subscription tier (Free, Pro, or Max). We may update, modify, or discontinue features. Where changes materially reduce service for paid subscribers, we will give reasonable advance notice and offer pro-rata refund or cancellation.

5. Subscriptions and payments

  • We offer subscription tiers as described on our Pricing page, with both monthly and annual billing options.
  • All prices are displayed inclusive of VAT. The total price, billing frequency, minimum commitment (if any), and renewal terms will be clearly shown before you confirm your subscription. The checkout button is labelled “Subscribe and pay” in accordance with Regulation 14 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Subscriptions renew automatically at the end of each billing period at the rate in effect at the time of renewal. We will send you a reminder email 5 working days before each annual renewal and before the end of any free trial period. You can cancel auto-renewal at any time through your account settings.
  • A subscription is a service bought at a distance, so the Consumer Contracts Regulations 2013 give you 14 days, starting the day after you subscribe, to cancel for any reason. Your paid features start straight away, at your express request, so Regulation 36 applies: if you cancel within the 14 days, you pay a proportionate amount for the service you have already had and we refund the rest. You lose the right to cancel only once the service has been fully performed, and a monthly or annual billing period is never fully performed inside its first 14 days.
  • After the 14 days, you can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access until then. No partial refunds are issued for the current period except where we are at fault.
  • Our Refund Policy explains how to cancel, what happens to your access afterwards, and when we refund you.
  • We use Stripe to process payments. By subscribing you also agree to Stripe's terms.
  • If a payment fails, we will retry in line with standard payment processor practice. Persistent non-payment may result in account suspension until payment is resolved.

6. Credit system

  • Some features (such as the Race Engineer AI chat) use a credit system. Each subscription tier has a monthly credit allowance, granted in full at the start of each billing month.
  • Unused monthly credits do not carry over to the next month.
  • You may purchase top-up credit packs. These sit alongside your monthly allowance, are spent once that allowance runs out, and do not expire while your account is active.
  • Top-up credits are non-refundable once purchased but remain usable for as long as your account is active.
  • We may adjust credit costs and allocations with reasonable notice where operational costs change materially.

7. Use of AI features

Important: MyRacingPath uses Anthropic's Claude models to provide AI features, most notably the Race Engineer. AI-generated content may be inaccurate, incomplete, or outdated.

The Race Engineer is a support tool, not a substitute for qualified professional coaching, medical or fitness advice, mechanical or engineering advice, or official motorsport licensing or regulatory guidance from Motorsport UK or the FIA.

  • AI output on MyRacingPath, including Race Engineer chat and any AI review of the Racing Path you built, is opinion and guidance generated by a model, not a statement of fact. Your Racing Path itself is your own work: nothing changes it without you pressing Save. Facts in our championship database carry a verification date recording when they were last checked. You can report an error in either, and you can ask for a human to review any AI output at any time.
  • You must verify important decisions with appropriate qualified professionals.
  • Under section 9(3) of the Copyright, Designs and Patents Act 1988, outputs generated by the Race Engineer in response to your prompts are owned by you. You grant us a non-exclusive, worldwide, royalty-free licence to store and display such outputs within your account.
  • We do not use the content of your Race Engineer conversations, profile data, or any content you submit to train AI models. Anthropic, the only AI provider we send your content to, is contractually committed not to train on our data.
  • The Race Engineer is instructed to say plainly that it is AI whenever you ask, and to remind under-18 drivers periodically that they are talking to AI. We do not dress our AI features up as people. That is our own rule, not a legal requirement we are passing on.
  • For users under 18, additional safeguards apply to AI interactions: automated safety screening of what you type and of what the AI writes back, a safeguarding alert to our safeguarding contact when that screening finds a genuine concern, and an email to a parent or guardian as well for the most serious signals, where we hold an address for one.

8. The sponsorship agent

The Max tier includes an AI agent that helps you look for sponsors. This section says exactly what it does and does not do.

  • It finds local businesses that might sponsor you, using Google's Places service, scores each prospect, and drafts outreach messages in your own voice.
  • Messages are sent from your own connected Gmail account, not from ours, and only after a message has been explicitly approved by a human. If you are under 18, you approve every single message yourself before it goes anywhere. Sending without per-message approval is available only to users aged 18 or over, and only if they switch it on.
  • Sending is capped. On the Max tier the agent can send at most 60 outreach messages per month.
  • Replies that come back are screened automatically for signs of scams and manipulation before they reach you.
  • You can switch the agent off at any time, and switching it off stops all sending.
  • The agent is a tool that helps you search, write, and stay organised. We do not promise that any business will reply, meet you, or sponsor you. Sponsorship is never guaranteed, and nothing the agent writes or finds is a commitment by us or by any prospect.

9. Acceptable use

You agree not to:

  • Use the service for any illegal purpose or in breach of applicable laws.
  • Harass, abuse, threaten, or harm other users.
  • Post content that is illegal, defamatory, obscene, or infringes third-party rights.
  • Attempt to gain unauthorised access to any part of the service.
  • Use automated systems to access, scrape, or mine the service.
  • Impersonate any person or misrepresent your identity.
  • Circumvent credit limits, age verification, or other security measures.
  • Use the service in a way that damages, disables, or impairs it.
  • Use the sponsorship agent to send spam, to misrepresent who you are, or to contact anyone who has asked not to be contacted.
  • Submit content that depicts, promotes, or facilitates harm to children.

10. User content and licence

  • You retain ownership of content you submit to MyRacingPath, including driver profile information, setup notes, written posts, and uploaded images.
  • You grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to store, display, distribute, and promote that content strictly to operate and provide the service to you and other users, and (with your explicit consent for any external use) to market and promote MyRacingPath.
  • We do not use content from users under 18 for AI training, marketing, or promotional purposes without separate explicit parental consent.
  • You are responsible for ensuring your content does not infringe third-party rights or violate applicable law.
  • We may remove content that breaches these Terms or applicable law. We will notify you where possible.
  • When you upload a session file containing data for multiple drivers, you confirm that you are a participant in that session and that you consent to all lap time and timing data in the file being stored and processed by MyRacingPath for the purposes of session analysis and comparison. Timing data from third-party results pages imported via the timing link feature is publicly available data fetched on your behalf.

11. Your statutory rights

Nothing in these Terms affects your statutory rights as a consumer under:

  • Consumer Rights Act 2015 (services rights under section 49, digital content rights under sections 34 to 47).
  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Other applicable consumer protection legislation.

If our service does not meet the standards required by the Consumer Rights Act 2015, you may be entitled to have it put right, a price reduction where that is not possible, or a refund where we fail to put it right within a reasonable time.

12. Our liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of your statutory rights under the Consumer Rights Act 2015.
  • Any other liability that cannot lawfully be excluded or limited.

Subject to the above, our total aggregate liability to you under or in connection with these Terms is limited to the greater of £100 or the subscription fees paid by you to us in the 12 months preceding the event giving rise to the liability.

We do not accept liability for career outcomes, race results, sponsorship outcomes, or other performance-related matters (we are a support tool only); for third-party services linked from our platform; or for decisions you make based on AI-generated content.

13. Termination and account deletion

  • You may delete your account at any time through your account settings.
  • We may suspend or terminate your account where you materially breach these Terms or our Community Guidelines, fail to pay subscription fees, where we reasonably believe fraud or abuse is occurring, where we are legally required to do so, or where your continued use poses a safeguarding risk to others.
  • Where we terminate for cause, we will notify you and explain the reason. Where we terminate without cause, we will give at least 30 days' notice and pro-rata refund any unused subscription.
  • On termination or deletion, we will delete your personal data in accordance with our Privacy Policy, except where we are legally required to retain it.
  • Safeguarding records are the standing exception. Where a safeguarding concern has been recorded, we keep that record even after the account is deleted, with the link to the account severed. Our Privacy Policy and Safeguarding Policy explain this retention.

14. Changes to these Terms

  • We may update these Terms from time to time to reflect legal, operational, or commercial changes.
  • We will notify you by email at least 30 days before any material change takes effect. Minor clarifications or changes required by law may take effect immediately with notice.
  • If you do not accept a material change, you may cancel your subscription and receive a pro-rata refund.

15. Complaints, disputes and governing law

  • If something has gone wrong, tell us. Our Complaints page explains how to complain and what happens next: we acknowledge every complaint within 30 days, usually much sooner, and respond without undue delay.
  • These Terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you also keep the protection of any rules of the law where you live that cannot be taken away by agreement, and you can bring a claim in your local courts.
  • If we cannot sort it out between us, we are not signed up to an alternative dispute resolution scheme or an ombudsman. We would rather tell you that than leave you hunting for one.
  • You can take a dispute to court without a solicitor: the small claims track of the County Court in England and Wales, simple procedure in the sheriff court in Scotland, or the small claims court in Northern Ireland. Money claims in England and Wales can be started online at gov.uk/make-court-claim-for-money. Nothing in these Terms takes that right away.

16. General

  • If any provision of these Terms is found to be unenforceable, the rest of these Terms remain in effect.
  • Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • You may not transfer your account or these Terms to another person without our written consent.
  • We may assign these Terms to a successor entity (for example on sale of the business) without your consent.
  • Nothing in these Terms creates a partnership, agency, or employment relationship between us.
